This page will provide the necessary resources for development in the Oak Orchard plan of condominium area. Lots 1 to 42 shall be listed in the appropriate By-law section below. As per By-laws B2022-19, B2022-20, B2022-21, & B2022-22, a Holding Provision has been applied to each lot which must be lifted prior to any site alteration or development. In order to lift the Holding provision, a Site Plan Agreement must also be registered on Title.

In order for any new development or site alteration to take place, each lot will be required to lift the "H" Holding Provision and have a Site Plan Agreement registered on Title.
Each lot shall be required to complete an archaeological assessment in accordance with the Ministry of Heritage, Sport, Tourism and Cultural Industries guidelines. This assessment must be conducted by a registered archaeologist which shall be reviewed by the MSTC and entered into the Public Register of Archaeological Reports.
The Site Plan Agreement will provide a detailed site plan for all proposed and future proposals. The Site Plan Agreement is a binding legal agreement and will be registered on Title.
When application is being made to the Municipality, there is an affidavit portion of the application that is to be signed before a Commissioner of Oath or Notary Republic. The Municipality provides commissioning services free of charge at the time of receiving planning applications for the Municipality. The affidavit portion can be completed by an external Commission of Oath or Notary Republic if the applicant is unable to attend the office for submission. The Municipality will require an original documents mailed with the appropriate fee.

Oak Orchard Site Plan Approval & Holding Removal Application
A fee of five hundred dollar ($500.00) for application shall be received at the time of submission. This fee is associated with the removal of the “H” holding symbol by-law, the fee for the Site Plan Approval has been waived for Oak Orchard. The cost of Registration of the Site Plan Agreement by the Municipal solicitor will be invoiced to the applicant.
Once staff have deemed the application complete and received the appropriate fee's, staff will begin processing the request and circulating the received documentation for comment to the appropriate agencies. A Council meeting date will be determined at which the Site Plan Agreement and removal of Holding Provision will be presented to Council for their approval. Once Council approves the by-laws, the Site Plan Agreement will be sent to the Municipal Solicitor's office to be registered on Title and zoning of the applicant's lands shall be amended to remove the "H" holding provision. Subsequently, the property owner or agent may apply for building permits in accordance with the adopted site plan through Cloudpermit.
*Note Unlike section 34 (Zoning By-law Amendments) and section 45 (Minor Variances) of the Planning Act, the removal of a Hold and/or entering into a Site Plan Agreement does not require a public meeting and there is no twenty day appeal period.
